I hereby agree that, as partial consideration for participation in the Texas SandFest in Port Aransas, Texas, myself and my company will release the Texas SandFest, its partners, its officers, employees, volunteers and agents from any liability arising from myself and my company's use of the vendor space at the Texas SandFest and agree to indemnify and defend the Texas SandFest, its partners, its officers, employees, volunteers and agents for any damages, claim for damages or other litigation resulting from my participation in the Texas SandFest April 17-19, 2009. I agree to provide my own insurance and agree that the Texas SandFest, its partners, its officers, employees, volunteers and agents will not provide any insurance for me for any purpose. I further certify that I have authority for the organization represented.

along with your check and the Vendor Agreement When you arrive you must check in at SandFest Central, with Rita Brown, the Vendor Coordinator, before you set up. Please complete the Vendor Agreement below and include with your application and check.

Agreement I have read the rules and agree to abide by them. Only Spaces #44-53 may have
a generator. All Food Vendors must have
received permission from the Nueces County Health Department and they must have
their operation inspected and approved by that Department, Friday morning, at
SandFest. SandFest reserves the right
to redesign the layout if necessary because of tide or other changes. I am renting the use of the
space only. The spaces do
not include a booth, table or anything and no other rights are given
or implied. I agree to keep everything
within my allotted space. I agree to have all my
prices clearly posted. I will make sure that
nothing hangs over my space’s borders. No alcohol can be sold at
the event. SandFest reserves the right
to refuse or reject any Vendors they do not feel are appropriate for the Texas
SandFest. No bull-horns or other
aggressive “hawking” allowed. I agree to operate in a
safe and clean manner and that the Texas SandFest, partners, agents and their
volunteers are not responsible for any damaged caused by my actions, inactions
or carelessness. There is no security for
vendors at night so I will not leave anything of value. The event is not
responsible for any losses. SandFest reserves the right
to allow any flags, signs or vendor activities they find objectionable or may
offend some of the public. I, an authorized agent for
the company below, hereby agree to DEFEND, INDEMNIFY AND FOREVER HOLD HARMLESS
Texas SandFest, its partners, agents, servants, employees and any and all
persons, natural or corporate in privity with any of them, of and from any and
all claims direct, by third party or otherwise, brought by Vendor or any one
claiming through Vendor on account of or arising out of any acts of omission or
commission of Vendor. Texas
